1. PAYMENT METHOD
50% of the total price once the reservation is formalised. The remaining 50% before the beginning of the rental date, if the reservation is made at least 15 days before the charter.
100% of the total price, if the reservation is made within 15 days after the rental. The mentioned payment method cannot be modified without the consent of the LESSOR.
The final billing will be made after a final inspection of the boat at the time of leaving it at the port of destination or, failing that, the next day if the deposit has been made with a Credit Card or unless expressly agreed by both parties.

2. OBLIGATIONS OF THE LESSEE
to. The LESSEE is obliged to navigate solely and exclusively in Spanish territorial waters. To navigate outside the aforementioned waters, prior written consent must be obtained from the LESSOR. The LESSEE undertakes not to rent or lend the boat to third parties, not to participate in regattas of any kind (except with the express permission of the LESSOR), not to do cabotage or professional fishing, not to give navigation courses or use the boat for any purpose. another lucrative purpose, and to sail only under favourable weather conditions. For any of the aforementioned activities, express permission must be obtained from the LESSOR.
b. THE LESSEE must respect the laws and rules related to customs procedures and must keep a logbook and take care of the inventory of the boat during the rental. In the event of not hiring the additional services of a boat skipper (skipper), the LESSEE will be obliged to present a current qualification (minimum PNV Sailing) that accredits his or her nautical knowledge if he or she wants to crew the ship.
c. The LESSEE will be responsible for any possible infractions committed, in accordance with current Spanish laws, even if he is crewing the boat outside the rental period.

3. DOCUMENTATION
The Lessor will receive all the necessary documentation from the LESSEE, as well as a deposit to cover any damage or defect during the

duration of the rental of the boat. It is necessary that you keep this documentation in a safe place for the duration of the rental.

4. DELIVERY OF THE BOAT
THE LESSOR is obliged to deliver the boat in good condition, clean and ready to sail, with the fuel reserve tank full (unless expressly agreed with the LESSEE. Before signing the aforementioned contract, the LESSEE must inspect the rented boat, especially the equipment and inventory. Finding any type of failure or damage during the inspection that does not prevent the correct operation of the warehouse does not entitle the LESSEE to reduce the initial price that appeared in the offer.

5. DEPOSIT (APA)
At the time of signing the documentation and entering the boat, the client must pay a deposit (APA) as a deposit to cover any damage, damage due to misuse or collision of the boat that is not covered by the Policy. insurance. The deposit will depend on the boat and will be established in the Contract, it is ONLY 30% of the total price of the boat. The deposit can be formalised by credit card, transfer or cash. The deposit will be returned once the boat has been inspected after leaving it at the port of destination.

6. CANCELLATIONS
In the event that the LESSEE withdraws from the rental for any reason once the boat has been delivered, the LESSOR will retain the entire amount of the rental as damages, charging the LESSEE for all expenses arising from the cancellation, except in the case that The boat can be re- rented on days previously arranged by the LESSEE. In the event that the LESSEE cancels the rental 4 weeks before the provision of the service, the LESSOR will retain 50% of the total price until he or she finds a client for the previously reserved dates. If it cannot be rented, said amount will not be refunded to the LESSEE. If the cancellation is communicated less than 4 weeks in advance, the penalty will be 100%, with the same criteria previously stated. In any case, only the amount recovered will be returned.

7. DAMAGES
The LESSEE must immediately inform the LESSOR in the event of any damage, collision or deterioration of the vessel, regardless of the causes. The LESSEE must inform the LESSOR immediately of the necessary repair or need for spare parts. Each repair or arrangement without authorisation by the LESSOR will be charged directly to the LESSEE. Any damage, loss or damage caused by improper use by the LESSEE and his crew will be his responsibility. Said damages or defects will be deducted from the deposit and will be returned only if there is Vessel Insurance coverage and in the established amount, with the Excess being borne by the LESSEE.

8. RIGHTS OF THE LESSEE
If for any reason and beyond the responsibilities of the LESSEE, the boat is out of service, the LESSEE may request that the proportional part of the amount paid be returned and depending on the days that the boat was out of service, the LESSOR will try to provide a similar replacement boat for the same price.

9. TERMINATION OF THE RENTAL
The LESSEE must return the boat to the LESSOR at the port of final destination, at the agreed time, intact and with the fuel reserve tank full (unless expressly agreed with the LESSOR). The LESSOR will fill the fuel reserve tank in the event that the LESSEE has not done so. The amount of said operation will be charged to the deposit deposited by the LESSEE or by payment thereof. If the LESSEE does not return the boat to the base port at the agreed time, he must compensate the LESSOR by paying the daily rental price in triplicate for each day of delay (a full day will be counted if the boat is delivered after 12:00 p.m.) , along with the possible expenses incurred during its delay to the LESSOR. The delay may be justified only in case of major cause and if the LESSEE immediately communicated it to the LESSOR. In the event that the boat is returned in poor condition and/or extremely dirty, the LESSOR will have the right to deduct the final cleaning and/or arrangements from the deposit, including bank commissions. If the ship, for any reason, could not be delivered to the base port, a surcharge of €4 or €7/mile would be applied (€4 motorboat, €7 sailing boat).

And as proof of conformity, the participants, in their respective interventions, sign this contract in knowledge and approval of the clauses, in duplicate copies and for a single purpose.
